Terms of Service

Last updated: 2026-05-27 (draft)

These Terms of Service govern your use of HomyEvent (the "Service"), operated from Québec, Canada. By creating an account, listing a venue, offering services, or browsing the marketplace, you accept the terms below. The French-Canadian version (fr-CA) is the authoritative text for users located in Québec.

1. Acceptance and eligibility

You must be at least 18 years old (or the age of majority in your province or state) to create an account. The Service is offered to residents of Canada and the United States. We do not verify age at signup — you self-attest by accepting these Terms. We may suspend or terminate any account we reasonably believe to be operated by a person under 18 and will delete the account and its personal data under Loi 25 §28 on request from a parent, guardian, or the user themselves. By signing up you confirm that you meet the eligibility criteria and accept these Terms together with the Privacy Policy. If you do not agree, do not use the Service.

2. Account registration and responsibilities

Account access is passwordless: you sign in with a magic link or one-time code emailed to you, or via a third-party identity provider. You are responsible for the security of the inbox associated with your account and for all activity that takes place under your account. You must provide accurate information and keep it up to date. You may not impersonate another person or create an account on behalf of someone without their authorization.

3. Acceptable use

You agree to use the Service for lawful event-planning, venue listing, and service-discovery purposes only. You may not scrape, crawl, harvest, or extract data via automated means; reverse-engineer or probe the Service for vulnerabilities; submit content that is illegal, defamatory, fraudulent, or that infringes a third party's rights; interfere with other users' use of the Service; or attempt to bypass the Pro-tier paywall or per-listing quotas.

4. User content and licenses

You retain ownership of any text, images, video, reviews, and other content you submit ("User Content"). You grant HomyEvent a worldwide, royalty-free, non-exclusive license to host, store, transmit, display, and adapt your User Content for the limited purpose of operating the Service, including translating it across locales and producing thumbnails or transcoded media. You represent that you have all rights necessary to grant this license.

5. Intellectual property

The HomyEvent name, logo, and the design, code, and original written copy that make up the Service are owned by HomyEvent and protected by Canadian and international intellectual-property law. Nothing in these Terms transfers any of those rights to you. Third-party marks visible on the Service belong to their respective owners.

6. Listings and accuracy

Venue and service-provider listings are submitted by the operators of those venues and services. HomyEvent does not verify every listing and is not a party to any transaction or arrangement between users. You are responsible for the accuracy, completeness, and lawfulness of any listing you post, including pricing, availability, capacity, accessibility claims, and licensing or permitting representations.

7. Reviews and reports

Reviews must reflect first-hand experience and may not contain unlawful, defamatory, or harassing content. HomyEvent may remove reviews that violate these Terms or our community guidelines, and may suspend accounts that repeatedly violate review policies. Operators of reviewed listings may publish a public reply but may not retaliate against reviewers off-platform.

8. Subscriptions and billing

HomyEvent offers a Free tier and a paid Pro tier billed via Stripe at CAD $14.99/month or CAD $149/year. Pro subscriptions auto-renew at the end of each billing period at the same price unless you cancel. Québec Consumer Protection Act (CPA s. 230) disclosure for distance contracts: (a) for annual plans, we will send a written renewal notice to your account email between 30 and 60 days before the renewal date stating the renewed term, renewed price, and the deadline to refuse renewal; (b) you may refuse renewal without penalty by cancelling before the renewal date; (c) cancellation is available at any time from your billing portal and is no harder than the original signup — a single click — with no retention call required; (d) on cancellation you keep Pro features until the end of the paid period, after which your account converts to read-only Pro data for 30 days before downgrading to Free-tier quotas (Pro features restore automatically if you re-subscribe within that window). Refunds: a pro-rata refund of the unused portion is available on request within 10 days of an annual renewal charge if you did not intend to renew; otherwise no refund is offered for partial periods. Nothing in this clause limits your statutory rights under the Québec CPA or other applicable consumer-protection law.

9. Third-party services

The Service relies on third-party providers including Stripe (payments), Cloudflare (hosting and security), Mapbox (mapping), Resend (email), and our identity providers (Google, Facebook). Your use of features that depend on those providers is also subject to their respective terms and privacy policies, which we link to from the relevant features.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of listings, and uninterrupted or error-free operation, to the maximum extent permitted by applicable law.

11. Limitation of liability

To the maximum extent permitted by law, HomyEvent's total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid HomyEvent in the twelve months before the claim arose and (b) one hundred Canadian dollars (CAD 100). HomyEvent is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.

12. Indemnification

You agree to indemnify and hold HomyEvent, its officers, employees, and affiliates harmless from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any applicable law.

13. Termination

You may close your account at any time from your account-settings page. HomyEvent may suspend or terminate accounts that violate these Terms, that pose a safety or legal risk, or that have been inactive for an extended period. Account deletion triggers the 30-day grace window described in the Privacy Policy before personal data is removed.

14. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable in Québec, without regard to conflict-of-law principles. Nothing in these Terms waives mandatory rights you have as a consumer under the Québec Consumer Protection Act, Loi 25, PIPEDA, or any other applicable consumer-protection law. The French-language version of these Terms (fr-CA) is the authoritative text in case of inconsistency with any translation.

15. Arbitration

Disputes between HomyEvent and a business user (commercial venue or service provider acting in the course of business) shall, at the electing party's option, be finally resolved by binding arbitration administered in Québec City (Québec), in French, pursuant to the Code of Civil Procedure of Québec. Consumers: nothing in these Terms requires you to arbitrate a dispute. As a Québec consumer, you retain your right under article 11.1 of the Consumer Protection Act and the Civil Code of Québec to bring any claim before the competent courts of Québec, including the Small Claims Division of the Court of Québec (Division des petites créances) for claims within its monetary limit. Either party may bring claims concerning intellectual-property infringement, privacy violations, or injunctive relief in the courts of Québec without arbitration.
